Litigation and Arbitration

Litigation and arbitration are parts of the negotiation strategy and in some instances indispensible. Like any other true attorney, we enjoy getting embroiled in a contentious litigation. However we never lose sight of the true interests of our clients and where appropriate we advise them to settle the case out of the court.
We have represented our clients at all court levels in Iran. We also have the experience of representation in ad hoc arbitrations as well as institutional arbitration, mainly before Arbitration Center of Iran Chamber of commerce (ACIC). We are quite familiar with the ministry of petroleum (MOP) dispute settlement committee designed to settle the disputes between the MOP affiliates and their contractors.
In our team, two have written their L.L.M thesis on the cutting-edge issues in the vast area of international commercial arbitration.

Finance and Islamic Finance

Decline of the oil prices and the resultant shrinkage of the government budget as well as the privatization trend would necessarily dictate utilization of other financial resources for the implementation of major projects in Iran. Project finance, equity financing and debt financing are the common variants of financing. Different generations of risk service buy-back contracts for oil and gas E & P operations has been in use in Iran for more than two decades. In recent years, DBF (more frequently referred to as EPCF contracts in Iran) has seen a constant growth both in oil & gas and elsewhere. Along this trend, Islamic finance has also found its way worldwide and is rising in Iran as well. We have been extensively involved in buy-back and EPCF contracts. Our people have outstanding expertise in financing and Islamic finance and are capable of providing a full range of services in this area. We are also on good terms with some reputable Iranian banks which would facilitate procurement of finance for certain projects.

Intellectual Property, Licensing and Franchising

Intellectual property (IP) is a key asset for most businesses today, especially start-ups and licensing and franchising of IP are the two most important methods to exploit them. Iran has started to modernize the body of law relevant to IP and our law firm keeps abreast of the developments. Our team is experienced in IP registration, management, enforcement and litigation. We have also played a key role in negotiation of key licensing and technology transfer agreements in the oil & gas, petrochemicals and automotive industry. “Licensing agreements”, a well-received book by both academia and practitioners, is written by a member of our team combining his academic knowledge and real world expertise.

Foreign Investment in Iran

Foreign Investors need to take into account different variables for a successful business in Iran. This starts with basic questions as to the method one chooses to enter into Iran market, regulatory considerations, market analysis, banking and financial regulations, investment protection and incentives afforded to foreign investors and many other issues. We help you analyze the risks and rewards of your entry to Iran, recommend the most viable option taking account of your needs and objectives, support you to establish and continue your business in Iran.

Construction and Engineering

Our team has extensive expertise with construction and engineering contracts in Iran. Most of our people have worked as in-house lawyers or advisers to major contracting companies in Iran and as a result are masters of the legal issues relevant to the industry. We were involved in the negotiation, drafting and finalizing numerous high value EPC, PC and EP contracts particularly in the oil and gas sector, have dealt with different types of standard construction contracts and claims arising thereof and played a key role in high-stake contentious litigation and arbitration of complex construction disputes.
